Please read these terms carefully before using our services

These Terms of Use govern your access to and use of Tawabiry services and applications. Please note that we are currently in Beta/MVP phase, and these terms will be updated as our services evolve.

1. Agreement to Terms

By accessing and using tawabiry's services, you agree to be bound by these Terms of Use, our Privacy Policy, and any additional terms and conditions that may apply. These terms constitute a legally binding agreement between you and tawabiry.

If you do not agree with any part of these Terms, you must not access or use our services. By creating an account or using any part of our services, you represent that you are at least 13 years of age and capable of forming a binding contract with us.

2. Service Description

tawabiry provides queue management and business optimization services through:

  • Digital queue management systems
  • Business analytics and reporting tools
  • Customer feedback collection and analysis
  • Online store management capabilities
  • Appointment scheduling services

We currently operate in Egypt with plans to expand to other countries including Saudi Arabia, United Arab Emirates, and Germany. As we expand, additional regional terms may apply based on local laws and regulations.

Beta/MVP Status: Our services are currently in development and testing phases. Features may change, become unavailable, or experience performance issues. We appreciate your understanding and feedback during this development period.

3. User Categories and Obligations

3.1 Business Users

Business users must:

  • Provide accurate business information and maintain its accuracy over time
  • Maintain confidentiality of account credentials and notify us immediately of any security breaches
  • Comply with all applicable local business regulations, licenses, and permits
  • Properly handle customer data in accordance with privacy laws and our Privacy Policy
  • Ensure accurate queue and service management, including reasonable wait time estimates
  • Maintain appropriate business insurance as required by local regulations
  • Respond promptly to customer inquiries and feedback through our platform
  • Comply with any service level agreements established with tawabiry

3.2 End Users (Customers)

End users must:

  • Provide accurate personal information for account creation and queue management
  • Use the service responsibly and for its intended purposes
  • Respect queue positions, business policies, and appointments
  • Not manipulate, hack, or abuse the queuing system
  • Not engage in disruptive behavior that interferes with other users
  • Not use automated systems or bots to interact with our services
  • Not impersonate others or provide false information
  • Maintain the confidentiality of account credentials

4. Account Management

4.1 Account Creation and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Create only one account per person or business entity
  • Provide accurate and complete information during registration
  • Update your information promptly if it changes
  • Use strong, unique passwords and enable additional security features when available
  • Notify us immediately of any unauthorized access or security breach

4.2 Account Termination and Suspension

We reserve the right to suspend or terminate your account at our sole discretion, particularly if:

  • You violate these Terms or other applicable policies
  • We suspect fraudulent, abusive, or illegal activity
  • You provide false or misleading information
  • Extended periods of account inactivity occur
  • Your continued use poses a security risk

Following termination, we will retain your data for the periods specified in our Privacy Policy. Business users seeking account deletion must contact our support team directly. During our beta phase, end-user account deletion requests will be processed manually through privacy@tawabiry.com.

5. Payment Terms

Business partners using our services agree to the following payment terms:

  • Payment Methods: We accept payments via InstaPay (Egypt) and direct bank transfers. As we expand to other regions, we will add localized payment options.
  • Subscription Fees: Business services are subscription-based with pricing tailored to business needs. All fees are exclusive of applicable taxes.
  • Billing Cycles: Subscriptions are billed according to the plan selected. You authorize us to charge your payment method on a recurring basis.
  • Free Trial: We may offer free trials or promotional periods. Unless otherwise specified, these will automatically convert to paid subscriptions.
  • Refunds: Refund policies are determined case-by-case during our beta phase. Contact our support team for refund requests.
  • Payment Disputes: For payment disputes, contact us within 30 days of the charge with detailed information about the issue.

6. E-commerce Terms

For businesses using our e-commerce features:

  • Must comply with Egyptian e-commerce regulations and applicable laws in their operating jurisdiction
  • Are solely responsible for product accuracy, availability, quality, safety, and legal compliance
  • Must handle customer data according to applicable data protection laws and our Privacy Policy
  • Are responsible for product delivery, customer service, and post-sale support
  • Must maintain accurate pricing, inventory, and product descriptions
  • Are required to have appropriate return and refund policies clearly communicated to customers
  • Must comply with consumer protection laws, including disclosure requirements and cooling-off periods
  • Are responsible for applicable taxes and duties related to their transactions

7. Data Usage and Privacy

We collect and process data in accordance with our Privacy Policy and applicable data protection laws. By using our services, you consent to our data practices as described in the Privacy Policy, including:

  • Collection of personal and business information necessary for service provision
  • Processing of queue and service usage data for analytics and service improvement
  • Storage and analysis of location data when using location-based features
  • Sharing data with authorized third-party service providers
  • Use of anonymized data for AI training and wait time prediction modeling

AI Wait Time Prediction (Project Sia): Our service uses anonymized historical service data to develop predictive models for wait times. You consent to the use of service duration and queue flow data for this purpose. No personally identifiable information is used in this modeling.

8. Intellectual Property

All tawabiry content, features, and functionality are owned by tawabiry and protected by Egyptian and international intellectual property laws, including:

  • Trademarks, logos, and brand elements
  • Software, code, and algorithms
  • User interface designs and visual elements
  • Text, graphics, images, and multimedia content
  • Data structures and compilation methods

You are granted a limited, non-exclusive, non-transferable license to use our services for their intended purposes. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any portion of our services without our explicit written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • tawabiry is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied
  • We do not guarantee uninterrupted, secure, or error-free operation, particularly during our beta phase
  • Our liability for any damages arising from the use of our services shall not exceed the amount paid by you, if any, for using our services during the three months prior to the event giving rise to liability
  • We are not liable for indirect, incidental, special, exemplary, or consequential damages
  • We are not responsible for actions, content, information, or data of third parties
  • Any claim arising from these Terms must be filed within one (1) year after such claim arose

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless tawabiry, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content or information posted or transmitted through our services
  • For business users, any claims related to products or services offered through our platform

11. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms:

  • Informal Resolution: We encourage you to contact us first to seek an informal resolution at support@tawabiry.com
  • Formal Dispute Process: If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in accordance with Egyptian arbitration laws
  • Venue: Any legal proceedings shall be brought exclusively in the courts of Egypt
  • Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class action

This dispute resolution provision will be governed by Egyptian law. For users in jurisdictions where mandatory arbitration is not enforceable, local laws will apply.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through:

  • Email notifications to the address associated with your account
  • Prominent notices on our website or within our application
  • Updates to the "Last Updated" date at the top of these Terms

Your continued use of our services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new terms, you must stop using our services.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Egypt, without regard to its conflict of law principles. As we expand to other countries:

  • For users in Saudi Arabia and UAE, these Terms will be supplemented with country-specific provisions as required by local regulations
  • For users in Germany and other EU countries, GDPR and consumer protection regulations will apply in addition to these Terms
  • Where local consumer protection laws provide greater rights, those provisions will take precedence

14. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of tawabiry.
